On January 11, 2005, this Court issued an opinion affirming Defendant Jason Settles conviction and sentence for being a felon in possession of a firearm, in violation of 18 U.S.C. § 922(g). United States v. Settle, 394 F.3d 422 (6th Cir. 2005). On June 6, 2005, the United States Supreme Court granted Settles petition for a writ of certiorari, vacated the judgment of this Court, and remanded to this Court for further consideration in light of United States v. Booker, 543 U.S. __, 125 S.Ct. 738 (2005). Settle v. United States, __ U.S. __, 2005 WL 1113831 (June 6, 2005). We hereby reinstate our opinion of January 11, 2005, with the exception of the last sentence of the first paragraph and Parts III and IV, which shall be amended as specified below.
