This is an appeal from a condemnation action brought by the United States pursuant to the Meat Inspection Act, 21 U.S.C. Â§Â§ 601-695, alleging adulteration of certain beef and offal owned by Jarboe-Lackey Feedlots, Inc. Following an extensive trial, the district court concluded that the government had failed to meet its burden of proving adulteration, 21 U.S.C. Â§ 601(m)(1), (m)(2)(A), and (m)(3), and dismissed the libel action. The trial court later denied Jarboe-Lackeys petition for attorneys fees under the Equal Access to Justice Act (EAJA), 28 U.S.C. Â§ 2412 (Supp. 1983), finding that the governments position was "substantially justified" and that the United States had acted in good faith.
